Terms and Conditions
These terms explain the proposed £59 monthly Tradesmen's Websites™ service. They are written primarily for UK trade businesses purchasing the service for business purposes.
1. About the service
Tradesmen's Websites is operated by Gareth Williams under the Tradesmen's Websites brand and is powered by WebUp®. The service provides a managed, hosted website platform designed for UK trade businesses.
References to “we”, “us” and “our” mean the operator of Tradesmen's Websites. “Customer”, “you” and “your” mean the business or person purchasing the service for business use.
2. The subscription
The standard service costs £59 per month, unless a different price is agreed in writing. It is a rolling monthly subscription with no fixed minimum term and no standard setup fee.
Payments are taken in advance for each monthly billing period. When Stripe Checkout is enabled, Stripe will process the payment and may store payment details under its own terms and privacy notice.
3. What is included
The standard subscription includes:
- A professionally presented website based on the Tradesmen's Websites platform and available trade layouts.
- Branding using the customer's supplied logo, business details and selected colour where technically suitable.
- Selection from up to 12 currently supported services for the chosen trade.
- Up to 20 genuine service areas.
- Relevant homepage, contact, service, area and service-plus-area page structures supported by the platform.
- Responsive layouts for common desktop, tablet and mobile screen sizes.
- Website hosting, SSL and routine platform maintenance.
- Use of an existing domain or a suitable available .co.uk domain supplied while the subscription remains active.
- Reasonable support relating to the operation of the subscribed website.
4. What is not included
Unless separately agreed, the subscription does not include:
- A bespoke website designed or coded entirely from scratch.
- Unlimited custom development, integrations or design revisions.
- Email mailbox hosting, paid advertising, social-media management or ongoing SEO campaigns.
- Professional photography, video, logo design or specialist copywriting outside the platform's standard content process.
- E-commerce, online booking, customer portals or third-party systems not included in the standard platform.
- Guaranteed search-engine rankings, traffic, leads, sales or revenue.
Additional work may be quoted separately before it begins.
5. Customer responsibilities
You agree to provide complete, accurate and lawful information, including:
- Correct business and contact details.
- Only services genuinely offered and areas genuinely covered.
- Logos, photographs and content that you own or have permission to use.
- Domain, DNS or registrar access where an existing domain is used.
- Prompt review, feedback and approval.
- Any licences, registrations, insurance details or legal wording required for your trade.
You remain responsible for the accuracy of your business claims, prices, qualifications, accreditations and regulatory information.
6. Build, review and launch timescale
We aim to build, review and launch most standard websites within 7 days after we have received all required information, usable assets, domain access and customer approvals.
The 7-day timescale is a service target, not an absolute guarantee. It may be extended by missing information, delayed approval, domain-transfer issues, unusual requirements, third-party outages or circumstances outside our reasonable control.
7. Review and amendments
Before launch, you will have a reasonable opportunity to check the website and report factual errors or reasonable changes within the standard platform. Requests that substantially change the agreed scope, require bespoke development or involve repeated redesign may be quoted separately.
After launch, reasonable updates to core business details may be requested. We may define fair-use limits where the quantity or frequency of requests becomes excessive.
8. Domains
Using an existing domain
You may use an existing domain if you control it and provide the access or DNS changes needed. You are responsible for existing registrar charges, renewals, email services and third-party arrangements unless agreed otherwise.
Free .co.uk domain option
Where you do not have a domain, we may register one suitable available .co.uk domain for use with the subscribed website. Availability cannot be guaranteed and the final domain must be agreed.
The registration and normal renewal cost of that domain is included while the subscription remains active. Premium domains, aftermarket purchases and additional domains are not included.
Transfer after cancellation
We will not unreasonably prevent transfer of a customer-specific domain after cancellation, provided all outstanding sums are paid and the transfer is technically and contractually permitted. Registrar, renewal, transfer or administration charges may apply and will be explained before the transfer proceeds.
9. Intellectual property and ownership
You retain ownership of original logos, photographs, trademarks and text you supply.
We retain ownership of the Tradesmen's Websites platform, source code, templates, reusable layouts, components, database structures, automation, software, design system and other underlying intellectual property. The subscription gives you a limited right to use the resulting hosted website while your subscription is active; it does not transfer the platform source code or reusable system to you.
Where we create standard platform content or imagery, rights to use it may depend on the platform subscription and relevant third-party licences.
10. Acceptable use
You must not use the service for unlawful, misleading, fraudulent, abusive, infringing or harmful material. We may remove content or suspend the service where reasonably necessary to protect users, third parties, our infrastructure or our legal position.
11. Search engines and marketing results
The platform provides search-friendly technical and content foundations. Search engines independently decide whether, when and where pages appear. We do not guarantee rankings, indexing, traffic, enquiries or commercial results.
Creating multiple pages does not remove the need for accurate content, genuine local relevance, a strong business reputation and compliance with search-engine guidelines.
12. Availability, maintenance and backups
We aim to keep the hosted service available and secure, but uninterrupted service cannot be guaranteed. Planned maintenance, emergency work, internet failures, cyber incidents and third-party outages may affect availability.
We may make platform changes, security updates and reasonable feature adjustments. We use appropriate backup arrangements, but customers should retain copies of their important original content and images.
13. Cancellation
You may cancel at any time by using the available account or billing cancellation method, or by contacting us at hello@tradesmenswebsites.co.uk.
Unless agreed otherwise, cancellation takes effect at the end of the current paid billing period. The website may then be unpublished and access to subscription features will end. Monthly payments already due or paid are normally non-refundable for a partly used billing period, except where required by law.
We may suspend or terminate the service for non-payment, serious misuse, legal risk or material breach of these terms. Where reasonably possible, we will provide notice and an opportunity to remedy the issue.
14. Failed payments
If a payment fails, we or our payment provider may retry it and contact you. We may suspend the website if payment remains overdue. You remain responsible for charges incurred before suspension or cancellation.
15. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
Subject to that, we are not responsible for indirect or consequential loss, lost profit, lost business, loss of anticipated savings, loss caused by search-engine changes, or loss resulting from inaccurate customer-supplied information.
Our total liability arising from the service will not normally exceed the total subscription fees paid by you during the 12 months immediately before the event giving rise to the claim. This limit does not apply where the law prevents it.
16. Changes to the service or terms
We may update the service and these terms to reflect legal, security, operational or commercial changes. Material changes affecting an active subscription will be communicated with reasonable notice where practicable.
17. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights that apply.
18. Contact
Questions, support requests and cancellation notices can be sent to hello@tradesmenswebsites.co.uk.
Plain-English commitment
Our intention is straightforward: one clear monthly price, no fixed-term contract, fair domain arrangements and a professional managed website service. Before live checkout is enabled, the final commercial settings shown during signup will form part of the agreement.
